These are the terms and conditions applicable to the beverage/merchandise based rewards scheme tied to purchase behaviour ("Barista Bar Loyalty Scheme"), the My Barista Rewards+ mobile app from the Google Play or Apple stores ("Loyalty App") and website at www.mybaristabar.com (“Site”).
These terms and conditions govern the relationship between Henderson Foodservice Limited a company incorporated in Northern Ireland with company number NI006894 whose registered office is at 1 Hightown Ave, Newtownabbey, BT36 4RT ("Barista Bar", “our”, "we" or "us") and you; with these terms and conditions to be referred to hereafter as the “Terms and Conditions”.
The Barista Bar Loyalty Scheme, My Barista Bar Rewards+ mobile app, website (www.mybaristabar.com) and any sub-domains are operated by Barista Bar. Barista Bar offers this website, including all stories, information, tools and downloads ("Services") available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
Please read these Terms and Conditions carefully before accessing or using our website, including all Services available from this site to you, the user. By visiting our website and/or registering for our Loyalty Scheme, you engage in our Services and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.
Your usage of the Barista Bar Loyalty Scheme can be managed by downloading the Loyalty App or through an official, branded plastic card displaying your card number and barcode ("Card/Key Fob") . New Card/Key Fobs will be limited in circulation to pick up from store from 1st January 2024.
Any new features or tools which are added to the current website and Services shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. You waive any right to receive specific notice of such changes. Your continued use of the website, including all Services available from this site to you, the user, will confirm your acceptance of such changes or modifications.

We reserve the right to refuse Service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
We engage with three designated data processors to facilitate our Services to handle specific data processing activities, namely PDI Technologies (fulfilling Stamp loyalty redemptions at Point of Sale); Sugar Rush Creative Ltd (managing our Loyalty App and Reward+ merchandise Points) and dotdigital EMEA Limited (providing bespoke and automated email sends).
We are not responsible if information made available on our website or associated Services is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
Registering via our Loyalty App or using the details of a physical Card/Key Fob enables you to redeem the beverage related stamps ("Stamps") and merchandise related points ("Points") you have earned on certain purchases in participating Barista Bar outlets.
Stamps can be earned and redeemed instore using either the Loyalty App or a physical Card/Key Fob.
Rewards+ Points can only be earned if you are registered for the My Barista Bar Rewards+ Loyalty App; and can only be redeemed via the Loyalty App.
After 18th December 2023 you can join the Scheme by downloading the My Barista Bar Rewards+ Loyalty App from the Google Play or Apple App stores (which will be free of any charge) and following the registration process once installed on your device.
You must register to redeem your free coffee and other offers.
You can only register for the Scheme in the name of one individual. You cannot register your account in the name of more than one individual.
You agree to provide current, complete and accurate account information for the individual registering. You agree to promptly update your account and other information, so that we can administer Services and contact you as needed.
Existing registered Barista Bar Loyalty Scheme users do not need to register a completely new account to use our My Barista Bar Rewards+ Loyalty App. Existing users can set up a mobile account using your existing Loyalty Card Number or the email address you provided when you originally registered. Any existing earned Stamps will then automatically appear on the homescreen of the Loyalty App, and you can then start to build up Points as well with each subsequent purchase. Your existing loyalty card/key fob will also continue to earn and redeem you Stamps if scanned at the till instore.
You can use the Scheme at any participating Barista Bar outlet in Northern Ireland. This will include most SPAR, EUROSPAR, ViVO, ViVOXTRA or ViVO Essentials branded stores across Northern Ireland, with a limited number of exceptions.
You can use the Scheme, subject to the provisions of this Agreement, to earn Stamps and Points whenever you purchase a Barista Bar beverage eligible within the scheme. This only includes beverages served from the Barista Bar stand or in the Barista Bar café.
Barista Bar locations outside of Northern Ireland may operate their own loyalty offers but are not participants in this Scheme. Purchases from these stores will not earn Stamps or Reward+ Points within this Scheme, and these locations will not redeem Stamps for free coffees from purchases earned in Northern Ireland stores.
Stamps can only be earned at the time of purchase and only if the Loyalty App or Card/Key Fob is presented at the time of payment. You will earn 1 Stamp for each Barista Bar beverage purchased. You can only collect Stamps for beverages served from the Barista Bar stand or in the Barista Bar café.
Once you have collected nine Stamps via the Loyalty App or your Card/Key Fob, you may use your Stamps to redeem one free hot beverage from a participating Barista Bar outlet. You may not make part payment for a purchase using Stamps. Stamps cannot be earned to the extent that a purchase is made with redeemed Stamps.
You can check your current Stamps balance on the Loyalty App, or on your receipt at the point of purchase at any participating Barista Bar outlet.
Redeeming Rewards+ Points is exclusive to those who have downloaded and set up their Loyalty App. Points can only be earned at the time of purchase and only if the Loyalty App or Card/Key Fob is presented at the time of payment. You will earn 1 Point for each Barista Bar beverage purchased from the point you download and register to use the Loyalty App. You can only collect Points for beverages served from the Barista Bar stand or in the Barista Bar café.
You may use your Points to redeem free merchandise and special offers listed in the Rewards+ section of the Loyalty App. All redemptions must be managed through the Loyalty App. You may not use Points in any participating Barista Bar outlet as these cannot be exchanged for hot beverages or any other products instore. You may not make part payment for products using Points. Points cannot be earned to the extent that a purchase is made with redeemed Points.
You can check your current Points balance on the Loyalty App.
On registration of your account, you will be gifted one free Barista Bar beverage to redeem in participating stores. Eligibility for this free coffee is limited to a single account per individual. If we have reasonable grounds to suspect abuse of the free registration beverage process, we reserve the right to suspend your account and take further action.
On sign up, you will be asked to specify your date of birth. Each year, you will be gifted one additional free Barista Bar beverage to redeem in participating stores. This free beverage will be added to your account to use from the Monday prior to your birthday that year, and will be available to redeem until the Sunday following your birthday that year. Any Birthday beverages not redeemed during your Birthday Week (Monday to Sunday) will then be removed from your account. Missed Birthday redemptions will not be reinstated and your date of birth will not be altered from what was provided during sign up.
The Scheme cannot be used in conjunction with any discount or privilege card whether issued by us or by any third party.
Stamps and Points are personal to you. You cannot combine or pool Stamps or Points with those of another Scheme user and you cannot redeem Stamps or Points together with another Scheme user. You cannot transfer your Card/Key Fob or Loyalty App or any stored Stamps or Points on it to any other person.
Stamps and Points have no cash value. Stamps and Points can only be earned, retained and redeemed as set out in this Agreement. Any Stamps or Rewards+ Points obtained or used otherwise than in accordance with this Agreement will be invalid and cannot be redeemed. Once Stamps and Points are redeemed they become null and void and cannot be redeemed a second or more time.
Your Card/Key Fob or Loyalty App is not a credit card, charge card or debit card. Please note that your Card is issued by, and remains the property at all times of, Henderson Foodservice Limited.
If you need to change any of the details you provided when you registered , you can update your details after registering for the Loyalty App at any time within the app, or by e-mailing firstname.lastname@example.org.
The email address associated with your account can only be changed by e-mailing email@example.com. We will ask you to confirm other account details to verify your identity before making any changes.
If your Card/Key Fob is lost, stolen or damaged you may lose any Stamps or Points you have earned.
If a device with your Loyalty App installed is lost, stolen or damaged you may lose any Stamps or Points you have earned.
Stamps and Points earned through using the Scheme are not covered by any compensation scheme.
You should immediately report any loss or theft of your Card/Key Fob or Loyalty App device, or any fraudulent or unauthorised use of your Loyalty account by emailing firstname.lastname@example.org.
If your Card/Key Fob or phone is lost, damaged or stolen or someone makes unauthorised use of your Account we may, at our sole and absolute discretion, transfer any Stamps or Points stored on your Card to a replacement account managed through the Loyalty App and/or re-credit any Stamps or Points redeemed without your consent.
If you subsequently find or retrieve a Card which you have reported lost or stolen, you must notify Customer Services immediately by emailing email@example.com.
Your loyalty Account does not have an expiry date. However, Stamps are only valid so long as you have used your Card/Key Fob or the Loyalty App to earn Stamps in the previous 12 months. If your account has not been used in this way for 12 consecutive months, we reserve the right to remove Stamps, free registration beverages and birthday anniversary beverages from your account (as applicable).
Points must be used to redeem Rewards+ merchandise or offers within a 2 year period. We reserve the right to remove any Rewards+ points that have not been redeemed where the associated transaction date was more than 2 years ago.
Points that have expired or been removed as above cannot be transferred to a new account or reinstated. You have the right to cancel your account at any time by returning your loyalty card to Customer Services or uninstalling the Loyalty App from all devices. If you wish to cancel your involvement in the scheme altogether, please use the Delete Account function in the app or email firstname.lastname@example.org. If you cancel your account, you will lose the right to redeem all and any Stamps and Points that are unused at the time of cancellation.
We may, on notifying you, forfeit all accrued Stamps and Points, and/or suspend your right to collect and/or redeem Stamps and Points if you are in breach of this Agreement, if we have reasonable grounds to suspect that you are engaged in fraudulent or other criminal activities relating to us, your account, or if you supply false or misleading information to us.
Your Card/Key Fob and Loyalty App may only be used at participating Barista Bar outlets, which may be subject to change.
We reserve the right to terminate, discontinue, cancel or amend the Card/Key Fob or Loyalty App facility at any time without notice to you.
Complaints regarding any element of the Scheme should be sent in writing or by email to Customer Services, Barista Bar HQ, c/o Henderson Foodservice, 1 Hightown Ave, Newtownabbey, BT36 4RT or email@example.com. All complaints will be subject to the Barista Bar Complaints Procedure which will be provided to you on your request.

In no case shall Barista Bar, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.
Barista Bar shall not be held liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, acts of God, failure of network services and failure of data processing systems.

As a consumer you have legal rights in relation to goods that are not of a satisfactory quality or fit for purpose and services not carried out with reasonable care and skill. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards Office. Nothing in this Agreement will affect these legal rights.
You agree to indemnify, defend and hold harmless Barista Bar and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. We may transfer the benefit of this Agreement to any other company in the same group of companies as Henderson Foodservice Limited.
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and accordingly may deny you access to our Services (or any part thereof).
The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).
